1. Service Description

InspectAI Pro provides an AI-powered field inspection platform that analyzes photographs and other images to provide compliance scores, defect detection, and inspection reports. Our Service is provided on an "as-is" basis for businesses, inspectors, and organizations.

The Service includes:

• AI-powered image analysis using computer vision and machine learning
• Compliance scoring and categorized defect detection
• Automated report generation
• History and data management
• API access (Professional and Enterprise plans)
• Third-party integrations

2. Account Registration

To use our Service, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• Accepting responsibility for all activities under your account
• Notifying us immediately of unauthorized access
• Keeping your account information up to date

You agree not to use accounts for any fraudulent or unauthorized purpose. InspectAI Pro reserves the right to terminate accounts that violate these terms.

3. Acceptable Use Policy

You agree NOT to use the Service for:

• Illegal activities or violation of any laws or regulations
• Uploading offensive, defamatory, or discriminatory content
• Hacking, unauthorized access, or security attacks
• Reverse engineering or attempting to extract our AI models
• Spam, phishing, or malware distribution
• Copyright infringement or intellectual property violation
• Competition or creating derivative products
• High-volume automated access without authorization
• Harassing, threatening, or abusing other users
• False or misleading representations

4. Content Ownership and License

4.1 Your Content

You retain all rights to images and data you upload. However, by uploading content to the Service, you grant InspectAI Pro a limited license to:

• Process and analyze your content for providing the Service
• Store your content for the duration of your subscription plus retention periods
• Use aggregated, anonymized data for improving our AI models (opt-out available)

4.2 Our Content

All Service content, including software, features, functionality, design, and analysis results, is the property of InspectAI Pro or our licensors. You may use the Service only as permitted by these Terms. Unauthorized copying or modification is prohibited.

5. Payment and Billing

5.1 Pricing

Pricing and billing cycles are set forth on our pricing page. Prices are subject to change with 30 days' notice. Price changes apply to renewals, not active subscriptions.

5.2 Payment Terms

• Payment is due upfront for each billing cycle
• We accept payment through Stripe
• You authorize us to charge your payment method
• Invoices are sent to your email address

5.3 Failed Payments

If payment fails, we will attempt to retry for up to 3 days. If unsuccessful, your account will be suspended until payment is received. After 30 days of non-payment, your account and data may be permanently deleted.

5.4 Taxes

You are responsible for all applicable taxes on your subscription. If applicable, we will add and collect sales tax or VAT at checkout.

6. Refunds and Cancellation

6.1 Refund Policy

• Monthly plans: Refunds are available within 14 days of purchase if the Service is not used
• Annual plans: Refunds are available within 30 days of purchase
• After the refund period, no refunds are provided; you may cancel for future billing
• Refunds for overage charges are not provided

6.2 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing cycle. After cancellation, you will lose access to paid features, though we may retain your data per our Privacy Policy.

7. Service Level and Limitations

7.1 Service Availability

We aim for 99.5% uptime but do not guarantee continuous availability. We may perform maintenance, updates, or suspend service for security issues with reasonable notice when possible.

7.2 Limitations

• Request rate limits apply based on your plan
• Maximum file size: 25MB per image
• Concurrent analysis limits vary by plan
• Data retention periods vary by plan (6 months to 2 years)

8. AI Analysis Disclaimer

The AI analysis provided by our Service is for informational purposes and should not be relied upon as the sole basis for critical decisions, particularly regarding safety or compliance. Our analysis:

• Is generated by artificial intelligence and may contain errors or inaccuracies
• Should be reviewed by qualified professionals before taking action
• Does not replace human expertise, professional inspections, or regulatory audits
• May have limitations in certain environmental conditions or image quality

You are solely responsible for verifying analysis results and making decisions based on your professional judgment.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• InspectAI Pro is provided "as-is" without warranties of any kind, express or implied
• We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement
• We are not liable for any indirect, incidental, special, or consequential damages
• Our maximum liability is limited to the amount you paid in the 12 months preceding the claim
• These limitations apply even if we have been advised of the possibility of damages

10. Intellectual Property Rights

InspectAI Pro respects intellectual property rights. If you believe content on our Service infringes your rights, contact us immediately. We will investigate and remove infringing content as required by law.

You grant us a license to use your name and logo for marketing purposes, with the right to opt-out.

11. Termination

We may suspend or terminate your account and access to the Service if you:

• Violate these Terms of Service
• Engage in illegal or harmful activity
• Fail to pay your subscription after 30 days
• Pose a security risk to our Service

Termination is effective immediately or as required by law. Upon termination, your access to the Service ends and your data is handled per our Privacy Policy.

12. Indemnification

You agree to indemnify, defend, and hold harmless InspectAI Pro, our officers, employees, and agents from any claims, damages, losses, or liabilities arising from:
